Terms of Service

Who we are

HipGen (the "Service": the HipGen website and its tools) is run by SkybleLab Inc ("SkybleLab", "we", "us"). These Terms of Service are an agreement between you and SkybleLab. By creating an account or using the Service, you agree to these Terms, our Privacy Policy, Content Policy and Refund Policy. If you don't agree, please don't use the Service.

Who can use HipGen

• You must be at least 13 years old. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you and supervise your use.
• Purchases and subscriptions are for adults, or minors with a parent's or guardian's permission.
• You can't use the Service if you are barred from it under applicable law, or if we have closed your account before.

Your account

• You sign in with an email link or with Google. Keep access to that email or Google account safe: anyone who can open your sign-in links can use your account.
• You are responsible for everything done under your account. Tell us at once at hello@skyblelab.ai if you think someone else is using it.
• One person per account. Don't share, sell or transfer accounts, and don't create accounts to get around limits or a suspension.

What HipGen does

HipGen uses artificial intelligence to write rap lyrics, rap them in original AI voices, make beats and songs, and turn photos into rap videos. Some tools are free with an account; others use credits. We use third-party AI service providers to create outputs. We may add, change or remove features, voices, styles and tools at any time.

AI output is generated automatically. It can be inaccurate, unexpected, or similar to what other people receive, and it may not match your prompt. Check what you make before you share or rely on it.

Credits, plans and payments

• Prices. Prices are shown in US dollars on the Pricing page, before any taxes that apply. Payments are processed by Stripe; we don't store your full card number.
• Credits. Credits are used to generate songs, voices, beats and rap videos. Each tool shows how many credits it uses before you start. Credits have no cash value, can't be transferred or sold, and can't be exchanged for money, except where the law requires otherwise or under our Refund Policy.
• Credit packs are one-time purchases. Their credits stay valid for 12 months from purchase.
• Subscriptions renew automatically at the end of each billing period (monthly or yearly) and charge the payment method on file until you cancel. Each period's plan credits are added at the start of that period and expire at its end. You can cancel any time in Account → Billing; your plan stays active until the end of the period you've paid for, and no further charges are made.
• Failed generations. If a generation fails and produces nothing, its credits are returned to your balance automatically.
• Price changes. We may change prices or the number of credits a tool uses. Changes don't affect credits you've already bought; subscription price changes apply from your next billing period, and we'll tell you before they take effect.
• Refunds are covered by our Refund Policy.

What you upload

You keep ownership of the photos, lyrics, prompts and other material you upload or type ("Your Input"). You give SkybleLab a worldwide, non-exclusive, royalty-free licence to host, store, process and transform Your Input, and to share it with our service providers, only as needed to run the Service for you, keep it safe and meet legal obligations.

By uploading or using Your Input, you promise that:

• You own it or have every permission needed to use it this way.
• Every person shown in a photo is you or has given you permission to use their face and likeness to make AI content.
• No photo shows a minor without their parent's or guardian's consent, and you won't upload photos of public figures or celebrities.
• Your Input doesn't break the law or anyone's rights, including copyright, privacy and publicity rights, and follows our Content Policy.

What you make

Ownership. As between you and SkybleLab, and to the extent the law allows, you own the lyrics, vocals, songs, beats and videos you generate ("Outputs"), subject to these Terms. AI-generated material may not be protected by copyright in some countries, and similar Outputs may be generated for other users; we don't promise exclusivity.

Usage rights:

• Personal use, every plan. You may use Outputs for personal, non-commercial purposes on any plan, including posting them on your own social accounts without monetization.
• Commercial use, Pro plan only. Commercial use needs an active Pro subscription at the time the Output is generated. Commercial use includes selling or licensing the Output, distributing it on paid streaming services, monetized channels or posts, advertising, sponsored content and work for clients.
• Pro content keeps its rights. Outputs generated while your Pro subscription was active keep their commercial rights if the subscription later ends. Outputs generated on other plans don't become commercial when you upgrade; generate them again on Pro.
• No resale as stock. You may not resell generated beats, vocals or lyrics as standalone stock, sample packs or beat catalogs.
• Original voices only. HipGen's voices are original styles. You may not present an Output as the work or voice of a real artist, or use it to mislead people about who made it.

You are responsible for how you use and share Outputs. Where a platform or the law requires it, label AI-generated content as such.

Our licence to Outputs. You give SkybleLab a licence to store and process your Outputs to provide the Service (for example, to show them in My creations). We won't use your photos or your Outputs in our marketing without your permission.

Rules for using HipGen

Follow our Content Policy. In addition, don't:

• Break any law, or help anyone else do so.
• Make content that harasses, threatens, defames or sexualizes a real person, or any content that sexualizes minors.
• Create deepfakes meant to deceive, impersonate someone, or commit fraud.
• Copy, continue or imitate the lyrics of real songs, or try to make HipGen imitate a real artist's voice.
• Reverse engineer the Service, or scrape, automate or bulk-download from it except through features we provide.
• Try to break our security, access other people's accounts or data, or overload our systems.
• Use the Service or its Outputs to build or train a competing AI product.
• Resell or give access to the Service itself without our written permission.

We may refuse prompts, remove content, and suspend or close accounts that break these rules.

Copyright complaints

We respect intellectual property. If you believe content on HipGen infringes your copyright, email hello@skyblelab.ai with: your contact details; the work you say is infringed; where the content is on HipGen (a link if possible); a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the content and close the accounts of repeat infringers.

Our property

The Service, including its software, design, voices, styles, text, graphics and the HipGen name and logo, belongs to SkybleLab or its licensors. These Terms don't give you any right to them except to use the Service as described here. If you send us feedback or ideas, we may use them freely and without paying you.

Third-party services

The Service relies on third parties, such as Stripe for payments, Google for sign-in, and hosting, storage and AI service providers. Their own terms may apply to your use of their services, and we aren't responsible for them.

Ending your account

You can stop using HipGen at any time, and you can ask us to delete your account by emailing hello@skyblelab.ai from your account email. Cancel any subscription first so it doesn't renew.

We may suspend or close your account, or limit features, if you break these Terms, if we must for legal reasons, or if your account is used in a way that risks harm to others or to the Service. Where reasonable, we'll tell you why. If we close your account without cause, we'll refund the unused part of any prepaid subscription period. If we close it because you broke these Terms, unused credits are forfeited.

Sections that by their nature should survive (including ownership, licences you've given, disclaimers, limits of liability, indemnity and governing law) continue after your account ends.

Disclaimers

The Service and all Outputs are provided "as is" and "as available". To the fullest extent the law allows, SkybleLab disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, or that any Output will be accurate, unique, lawful to use in every way or fit for your purpose.

Limitation of liability

To the fullest extent the law allows:

• SkybleLab and its officers, employees and service providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or these Terms.
• SkybleLab's total liability for all claims arising from or related to the Service or these Terms won't exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$100.

Some places don't allow these limits, so they may not all apply to you. Nothing in these Terms limits liability that can't be limited by law.

Indemnity

You agree to defend and indemnify SkybleLab and its officers and employees against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from Your Input, your use of Outputs, or your breach of these Terms or of anyone's rights.

Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute arising from or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you and SkybleLab consent to their jurisdiction. Before filing a claim, please email hello@skyblelab.ai so we can try to resolve it informally. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.

Changes to these Terms

We may update these Terms. If a change is material, we'll tell you by email or in the Service before it takes effect, and we'll update the date at the top of this page. If you keep using HipGen after the change takes effect, you accept the new Terms; if you don't agree, stop using the Service and cancel any subscription.

Other terms

These Terms, together with the policies they link to, are the whole agreement between you and SkybleLab about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. If these Terms are translated, the English version controls where the law allows.
